In accordance with the law, all operations concerning collected personal data will be carried out according to the principles of correctness, lawfulness and transparency.

By visiting the company’s website (www.giustiwine.com), visitors accept the terms and conditions given below.

Type of data collected, purposes and methods of use

The website provides informative and interactive content. During browsing, information about visitors (web users) may be acquired in the following ways:

Navigation data

During normal operation, the IT systems and software procedures used to run this website collect personal data and transmission of such data is an inherent feature of Internet communication protocols. This information is not collected to be associated to identified individuals but it could, by its very nature, allow users to be identified after being processed and matched with data held by third parties. This category of data includes IP addresses, browser type, operating system, domain name and addresses of the websites from which access or exit has been made (referring/exit pages), information on pages visited by users within the site, access time, length of stay on each page, clickstream analysis and other parameters regarding the user’s operating system and IT environment, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used for submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.), and other parameters related to the user’s operating system and IT environment. 

These technical/IT data are collected and used on an aggregated and anonymous basis exclusively to improve the quality of the service and obtain anonymous statistics concerning use of the website and to ensure it is running properly. The data may be used to establish liability in the case of hypothetical computer-related crimes against the website and/or the Data Controller. Without prejudice to this possibility, data regarding web contacts will not be kept for longer than is necessary to carry out the purposes for which they were collected and subsequently processed.

These data are not associated with users who may access this site.

Data provided voluntarily

Data are provided voluntarily when the web user decides, after reading this Privacy Policy, to enter his/her personal data such as name, surname, email address and telephone number, in order to:

a) complete the details on the “Contacts” form. If you wish to receive an answer to your query, you must authorise the Data Controller to process your personal data and in particular must provide your name, surname, address, town/city, province, postcode, telephone number and email address. The purpose of the processing in question is to answer the query submitted by the data subject and the legal basis of the data processing is your consent, after having read this Privacy Policy. Consent may be withdrawn at any time following the instructions given in the last paragraph of this Privacy Policy. Failure to provide the personal data requested to process the request through the above-mentioned form will make it impossible for the Data Controller to respond. 

b) sign up to the newsletter as one of the options on the navigation menu. If you wish to provide your email address to receive the newsletter produced by the Data Controller, you will have to authorise the latter to process this address. The purpose of the processing in question is to periodically send you an email containing a description of the company’s latest products, initiatives and promotions. The legal basis of the data processing is your consent, after having read this Privacy Policy. Consent may be withdrawn at any time and, as a result, the newsletter will no longer be sent, taking into consideration the technical time needed to remove your address from the Data Controller’s database. Failure to provide data will make it impossible to send the newsletter.

c) purchase the Data Controller’s products on the e-commerce platform. In this case and for this purpose, you will only be asked to provide the data needed to carry out the activities prior to the conclusion of the purchase of the goods and/or services supplied by the Data Controller (e.g. preparation of a quotation) or to carry out the sales agreement for goods and/or services and, when appropriate, delivery. The legal basis of the processing in this case is the Data Controller’s need to fulfil a precontractual and/or contractual obligation pursuant to article 6 paragraph 1 letter a) of the GDPR. This after reading this Privacy Policy. Provision of your personal data is necessary to conclude the agreement or draw up a quotation and if you fail to provide them, it will not be possible to carry out the agreement or send you a quotation.

We would also like to inform you that the data which you freely provide may be disclosed to and processed within the company by staff duly appointed for the task and/or the appointed Data Processor, according to the respective authorisation profiles. When expressly requested and when authorised by law, the Data Controller may communicate data to law enforcement and the Police.

With regard to information generated by the third-party cookies used by our websites, they are communicated to Google Inc. within the limits indicated herein (see our Cookie Policy). No navigation data are in any way disclosed and shall not be transferred to countries outside the EU.

JavaScript and external services

JavaScript is a technique used as an alternative to direct analysis of Web server log files. 

It consists of collecting and processing navigation data using dedicated JavaScript code in the HTML pages deemed of interest. As regards external websites, we would like to inform you that this site uses the external web analysis service provided by Google Analytics, which uses JavaScript technology to allow the website to analyse how users use the site. The information generated regarding the use of the website by the user (including his/her IP address) will be sent and stored on Google Analytics servers. Google Analytics will use this information to track and examine use of the website, draw up reports on site activities for the website operators and provide other services related to website activities and use of the Internet. Google Analytics may also transfer this information to third parties where required by law or when these third parties process the above-mentioned information on behalf of Google Analytics.

Processing methods and transfer outside the EU

Data collected through this website are mainly processed electronically and the Data Controller takes appropriate security measures for their processing, as required by law.

The Data Controller does not transfer personal data collected (for the purposes referred to in points a), b) and c) of this Privacy Policy) to countries outside the European Union. The same applies for navigation data.

Retention period and recipients of the data

Data regarding navigation of the website are not retained by the Data Controller.

Data provided voluntarily (requests for information or signing up to the newsletter) using the relevant online channel (form) are retained for 24 months from the moment consent is given. Once this retention period expires, data are deleted or rendered irreversibly anonymous.

Data provided for the precontractual or contractual purposes referred to in point c) above shall be retained in accordance with the law concerning the limitation of rights, and in any case for 10 years from the performance of the agreement, except for events which may interrupt these deadlines.

Data subject rights

Data subjects are entitled to exercise their rights as set forth in articles 7, 15-22 of European Regulation 2016/679.

Specifically, for consent-based processing, data subjects are entitled to withdraw their consent at any time. They are entitled to request the Data Controller confirmation as to the existence or otherwise of personal data concerning them and to be notified of their contents in an intelligible form; they are entitled to request access to their personal data, receive the personal data supplied to the Data Controller and transmit them to another Data Controller without impediment (so-called data portability); update data, restrict the processing, rectify data and delete any data processed in violation of the law. They are also entitled to lodge a complaint with the Data Protection Authority in its capacity as the controlling authority concerning the protection of personal data.
